Terms of Service

1. Introduction
These Terms of Service govern your use of FleetWright, a cloud-based fleet maintenance management platform operated by FMR Digital LLC. By creating an account or using the service, you agree to be bound by these terms.
2. Definitions
- Service — The FleetWright web application and associated APIs hosted at app.fleetwright.app.
- Account — The credentials and configuration associated with a registered subscriber organization.
- Subscriber — The organization or individual that registers for and holds the account, responsible for billing and usage.
- User — Any individual granted access to the service under a subscriber's account.
- Content — All data entered into the service, including equipment records, work orders, repair logs, photos, and other information submitted by subscribers and users.
3. Account Registration
You must provide accurate and complete information when creating an account and keep that information current. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Each person may hold only one account. You must be at least 18 years of age to register.
4. Subscription and Billing
FleetWright subscriptions are billed on a recurring basis (monthly or annual) via Stripe. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
We may change subscription prices with 30 days' advance notice via email. Annual plans cancelled within the first 30 days of the current billing period are eligible for a prorated refund for unused time. No refunds are issued for partial periods outside this window.
5. Free Trial
New subscribers may access a 14-day free trial of the Professional plan. No credit card is required to start the trial. At the end of the trial period, you must select a paid plan to continue using the service. If no plan is selected, your account will enter read-only mode. Account data will be retained for 30 days following the end of the trial and any applicable grace period; after that it will be permanently deleted.
6. Data Ownership
You retain full ownership of all content you enter into FleetWright, including work orders, repair records, equipment records, and photos. FleetWright acts as a data processor on your behalf and does not claim any ownership rights over your data. You may export your data at any time through the application.
7. Acceptable Use
You agree not to use the service to:
- Engage in any illegal activity or violate any applicable law or regulation.
- Reverse engineer, decompile, or disassemble any part of the service.
- Scrape content or use automated access methods beyond the documented API.
- Resell, sublicense, or otherwise transfer access to the service to third parties.
- Share login credentials with other individuals.
- Intentionally interfere with or disrupt the availability or performance of the service.
8. Service Availability
We use commercially reasonable efforts to maintain the availability of FleetWright. We do not offer an uptime service level agreement (SLA) at this time. Scheduled maintenance windows will be communicated via email with at least 24 hours' notice when possible.
9. Limitation of Liability
FleetWright's total liability to a subscriber for any claim arising from these Terms or use of the service is limited to the fees paid by that subscriber in the 12 months preceding the claim. In no event shall FleetWright be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunity, even if advised of the possibility of such damages.
10. Termination
Either party may terminate the subscription with 30 days' written notice. FleetWright may terminate a subscription immediately upon material breach of these Terms. Upon termination, the subscriber has 30 days to export their data through the application; after that period, all data will be permanently deleted.
11. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law provisions. Any disputes arising under these Terms will be resolved in the courts of Georgia.
12. Changes to Terms
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
